This Privacy Policy explains the privacy practices of The Fruitful Yield, Inc. (“FY”), and describes the way we use and protect the information we collect from our Fruitful Yield Loyalty App (and other FY sites that may be linked to the App) (collectively referred to as the “App”) about customers and users. You must have an active Fruitful Yield Loyalty Program account to use the App.

WHAT INFORMATION DO WE COLLECT?

INFORMATION YOU CREATE OR PROVIDE TO US

When you create a Fruitful Yield Loyalty Program account, you provide us with personal information that includes your name (first & last), username, password, address, city, state, zip code, loyalty account number and date of birth. You can also choose to update add additional information to your account such as your preferred FY location, gender, purchase preferences and wellness goals.

INFORMATION WE COLLECT AS YOU USE THE APP

YOUR ACTIVITY

We collect information about your activity when using the App, including:

• When you open and close the App
• When you access coupons
• When you access QR codes
• When you open the App’s home screen on your phone
• When you create or update your profile
• When you log into and out of your account
• Whenever there is an error while you use the App
• Smoothie/soup points earned
• Loyalty Rewards redeemed
• When you update your preferred FY location
• When you receive a push notification
• When you access a push notification

YOUR LOCATION

We collect information about your location when you use the App which helps us offer features like sending you a notification when you are within 500 meters or roughly .12 miles of a FY store (“geofencing”).

Your location can be determined by using GPS, WiFi and phone networks to best locate your coordinates to detect when you’re within a 200 meter radius of a FY location.
The types of location data we collect depend on your device and account settings.

HOW TO ADJUST OR TURN OFF LOCATION SERVICES (APPLE DEVICES)

Apple users may adjust the location tracking settings or opt out of having your location tracked by 1) going to your Profile Page in the App and toggling the “Allow Fruitful Yield to track your location” button to Off; 2) you will be sent to the Access Settings page on your device that controls the App; 3) Click the “Location” menu; and 4) select when you want the App to track your location “Never,” “While Using the App,” or “Always.” If you select “Never,” location services will be disabled for the App. Turning off the Location Service will not affect your ability to otherwise use the App.

HOW TO ADJUST OR TURN OFF LOCATION SERVICES (ANDROID DEVICES)

Android users may adjust the location tracking settings or opt out of having your location tracked by 1) opening the phone’s Settings menu; 2) select the Fruitful Yield Mobile App; 3) Hit “Location”; and 4) toggle the location settings on or off.

WHAT DO WE USE YOUR INFORMATION FOR?

We use the information we collect from the App to:

• Administer the Fruitful Yield Loyalty Program;
• Improve customer service;
• Maintain & improve the App – we use your information to ensure the App is working as intended, such as tracking when you experience errors;
• Provide personalized services, including content and ads – we use the information we collect from you to customize your experience in the App as well as sending you coupons, ads, news, updates, promotions, and related product information;
• To understand how our App is used – we use the information collected to analyze and measure how our App is used. For example, we use the data and push notifications you interact with to help us understand performance of any ad campaigns or promotions; and
• Communicate with you via the email address provided in your profile to provide information and updates pertaining to your Fruitful Yield Loyalty Program account, in addition to receiving occasional company news, updates, promotions, related product or service information, etc. if such information was requested.

OPTING OUT OF PUSH NOTIFICATIONS AND/OR PROMOTIONAL EMAILS

You may opt out of receiving push notifications or emails from FY by going to your Profile page within the App and under “Account Info” toggle “Allow Fruitful Yield to send push notifications?” and/or “Would you like Emails about upcoming events and details?” to Off.

HOW DO WE PROTECT YOUR INFORMATION

While we have excellent security measures in place that meet or exceed industry standards, no data transmission over the Internet is a hundred percent secure. Although our top priority is to safeguard your personal information, we cannot guarantee the security of any information you submit to the App. Described below is a description of our security measures we have implemented to ensure the safety of your personal information.  These security measures include:

• password protected directories and databases to safeguard your information or SSL (Secure Sockets Layer) technology to ensure that your information is fully encrypted and sent across the Internet securely.
• IP addresses are stored in anonymous server traffic logs along with URL paths, browser version information and GeoIP information. IP addresses are only used for general server management and are NOT stored in any way that they can be connected to any of your personal information such as usernames or contact details.
• Your account passwords are not stored in our system, only secure cryptographic, one-way salted hashes. For passwords created or updated on or since October 18, 2019, bcrypt hashes are used. For passwords created or updated before October 18, 2019, SHA256 hashes with 32 byte random salts are used.
• The App contains Web Application Firewall hardware appliances, fully segmented firewall vlans to restrict network access, automated web application scanning to identify security flaws and an Intrusion Detection System.

DO WE USE COOKIES?

The App does not use cookies but other FY websites do in accordance with their applicable privacy policies.

DO WE DISCLOSE ANY INFORMATION TO OUTSIDE PARTIES?

 We do not sell, trade or otherwise transfer to outside parties your personally identifiable information without your consent. However, non-personally identifiable visitor information may be provided to other parties for marketing, advertising or other uses. We may use this information to address network integrity and security issues or to investigate, prevent or take action regarding illegal activities or violations of our other policies. We may also use this information if required by law. We may share information with trusted third party companies, entities and individuals to perform functions on our behalf; provided, however, that these third parties may access your personal information only on a confidential basis and only to the extent necessary to perform their functions, and all third party vendors must abide by our Privacy Policy.

APP PRIVACY POLICY ONLY

This Privacy Policy applies only to information collected through our App and not to information collected from other websites or offline.

CHILDREN UNDER 18

This App is not directed to nor does it knowingly collect any personal information from children under 18 years of age. If you are under 18, you may only use this App with the involvement of a parent or guardian.

YOUR CONSENT

By using our App, you consent to our Privacy Policy and Fruitful Yield Loyalty Rewards Program Official Rules.

If we decide to change our Privacy Policy, we will post those changes on the App, and/or update the Privacy Policy modification date below. Policy changes will apply only to information collected after the date of the change.

TERRITORIAL USE RESTRICTIONS AND JURISDICTION

This App is controlled and operated by The Fruitful Yield, Inc. in the United States. FY makes no representation that this Privacy Policy complies with any applicable laws outside the United States. Those who choose to access the App from locations outside the United States do so at their own initiative and risk.

This Privacy Policy and other policies on the App shall be governed by and construed in accordance with the laws of the State of Illinois. All claims, disputes, and lawsuits arising out of or in connection with this Privacy Policy shall be resolved or adjudicated in DuPage County, Illinois.
